This is the account of the baby's mother. It is dated according to when things happened in the life of little Jimmie and written in a very matter-of-fact style, similar to a diary.
7-10-91: Office visit to Dr. Salas. I was complaining of cramps. I stated that I was in early labor. Dr. Salas ordered complete bed rest for two weeks. New appointment in one week. My original due date was 8-30-91.
7-11-91: I went to Sierra View Hospital with early labor pains. I was there about two hours. The nurse stated that my contractions were not strong enough and for me to see Dr. Salas tomorrow morning.
7-12-91: Office visit to Dr. Salas. I told him that I went to the hospital with labor pains last night....Dr. Salas told me... if I kept having labor pains to come to his office or go to the hospital.
7-18-91: Office visit to Dr. Salas. His orders were complete bed rest with a new appointment on 7-24.
8-4-91: I went to Sierra View Hospital at 2 a.m. having labor pains. I was on monitors for one hour. When Dr. Salas was called to report on my condition, the doctor ordered to have me hooked up to IV medications to induce my labor. I then started my hard labor. I was given medications to relax me during delivery. Dr. Salas lost the suction cup on the baby. He had trouble getting the baby out. Every time I would stop pushing the baby would go back inside. The nurse had to hook me up to oxygen for hyperventilating. I hyperventilated through the whole delivery. At 9:47 a.m. Jimmie was born. My mother stated that his head looked like a cone head. At that time the nurse took the baby and cleaned him up and examined him.
(I feel at the time Dr. Salas lost the suction cup on the baby's head is when the fracture of the skull occurred..)
8-4-91: That afternoon my family came and stayed a couple hours. At that time we noticed the baby's legs were bowed real bad and his feet were curved in. The hospital put the baby on Similac. That evening he started choking on the formula and spitting it all up curdled. The nurse was called in. She put him on Pedialyte for a couple of hours to settle his stomach then put him on Isomil with iron. I was given pain pills for my pain because I was torn so bad.
8-5-91: I had a small breakfast. Dr. Salas said that I could be released. The baby had a blood test before we were released. Nurse told me to make appointment with Dr. Salas in six weeks. Dr. Rao came in to check the baby. He said that he wanted to see him on 8-6-91 because he thought he had jaundice and he wanted to check his legs and feet because they bowed and the feet were curved so bad.
8-6-91: Went to Dr. Rao at 1 p.m. Dr. Rao checked his heart out then stated he had a little bit of jaundice. Dr. Rao then checked his legs and feet. Doctor said if they don't straighten up in a month he would send Jimmie to an orthopedic surgeon. He sounded pretty sure that he would do that. He also told me if the yellow color got worse to call him. I told the doctor Jimmie was having troubles with formulas still (Isomil with iron). Doctor said give Pedialyte after formula bottles. Jimmie weighed 7 pounds and 14 ounces; length = 19 3/4 inches.
8-7-91: Constipation began. Started noticing pinky toe on right foot. Jimmie was also very fussy day and night.
8-8-91: Took Jimmie to Dr. Rao at 2 p.m. Nurse took temperature in the rectum. Dr. Rao came in and looked at Jimmie's color, still was a little jaundiced. Then stated "keep him in good light." Jimmie was still having trouble with his formula. Dr. Rao told me to switch formula to Isomil with low-iron. He said that could be what was making him constipated. Jimmie weighed 7 pounds, 15 and 3/4 ounces. His length was 19 and 3/4 inches.
8-11-91: Jimmie is still constipated. We didn't put disposable diapers on him - just laid him on a cloth diaper because his little bottom was sore and irritated. At around 7:30 p.m. Jimmie started having real hard bowel movements. We then saw real hard stool come out about the size of your pinky finger. It was two hard stools and they were covered with blood. Then I ran across the street to Karen Zimmerman's house to call my parents at church and reported blood was coming out with his stools. My parents said they would be right over to see what was wrong. I went back to the house to wait for them to arrive.
When they arrived my mother looked to see what the cloth diaper looked like. My mother at this time tried taking his temperature, and the baby kept trying to have a bowel movement. She moved the thermometer and it had a hard stool and blood on it. We then rushed him down to Sierra View emergency room and told the lady there he was one week old and bleeding through the rectum with his stools.
Mother and I went with Jimmie. The nurse took his temperature. Dr. Orsel arrived. I told him Jimmie has been fussy and cranky, and he was bleeding through his stools, and was constipated for a couple of days. I told the doctor that Dr. Rao had me putting half a teaspoon of Karo syrup in his bottles. Dr. Orsel took his heartbeat and looked in his mouth then looked at his rectum. Jimmie's buttocks was irritated. Doctor said his rectum was large. He stated it could be from constipation.
Doctor stuck his pinky finger up his rectum and told (mother) and I he would be fine, that he just had a fissure around his rectum that was causing the blood. Doctor told me to put A&D ointment in his rectum. I told him that I would not do that because I was afraid I would hurt him. Then he told me to call Dr. Rao to tell him Jimmie was in the hospital and gave me some glucose water to give Jimmie. Jimmie weighed 7 pounds, 14 ounces.
8-12-91: Took Jimmie to Dr. Rao at 1 p.m. Nurse took temperature in the rectum then Dr. Rao came in and checked his heartbeat. I told him what happened yesterday. He looked at Jimmie quickly then said to come back in one week for another appointment.
Jimmie weighed 8 pounds; was 20 1/4 inches long.
8-13-91: I went to Dr. Salas at 2:45 p.m. because I was still in a lot of pain. I couldn't urinate or pass stools. Dr. Salas examined me, then ordered me to complete bed rest, and put me on medication (Acetaminophen/codeine 300 mg. one to two tablets four times a day.)
8-18-91: Jimmie was fussy all day long. Later in the afternoon my mother changed his diaper and saw that there was some blood in the front of the diaper. We thought it was from his umbilical cord. Then my mother noticed his penis was colored. At this time the baby had runny stools and we kept close watch on him to see if there was any more bleeding.
At 6 p.m. my parents took us home. At 7:30 p.m. my husband started changing the baby's diaper and there was a lot of blood in the front and back of the baby's diaper. I started checking the baby to see where the blood was coming from. At this time I noticed that his penis was dark blue - more so than when my mother looked at him earlier. My husband told me to run across the street to Karen's house to call mom and dad at church. I told them Jimmie was having a lot of blood coming from his rectum and penis. They came right over and my mother took his temperature. It was normal.
Then we rushed Jimmie down to Sierra View emergency room and when we arrived at the emergency room I told the lady at the desk we had him here last Sunday for bleeding through his rectum. Now he is bleeding through his penis and rectum and his penis is dark blue in color. She told me to wait and someone would be right with us.
Then a lady from the back came out and took us in the hallway so she could take the diaper off and see what his penis looked like. She then put his diaper back on and told my husband and I to go back in the waiting room and wait for a bed to be available. So we went back to the waiting room and waited for about 45 minutes. Then someone came out and put us in a room. The nurse took Jimmie's temperature and then looked at his penis and then told us the doctor would be right with us. So my husband and I waited for the doctor to come in.
When the doctor came in he checked the baby's heartbeat and then took his diaper off and looked at his penis and asked what had happened to his penis. We told him we didn't know what had happened. Then he looked at his rectum and said that his rectum looked real large. I told him that his rectum had been real large since he was a couple of days old and I told him that (Jimmie) had been real constipated since we first brought him home from the hospital...
(Dr.Thistle) then told my husband and I that Jimmie looked to be sexually abused. At this time my husband and I were getting upset, and we told him he was wrong about that.
Then he stuck on some gloves then put lubricating jelly on his pointing finger then stuck his pointing finger through (the baby's) rectum and felt around.
Then he told my husband and I (the baby) would be o.k. and he was going to take some blood tests and give me some Pedialyte bottles to give Jimmie.
I said o.k.
He told me someone would be in soon to take the blood tests. He said after that Jimmie could be discharged. So we waited. Then the guy took the blood test and then the nurse said it would be a few minutes before the bottles were ready.
The next thing we knew there was another doctor, Dr. Kazaro, that came through and two police officers and a CPS worker, Judy Howard, and a detective, Paul Marshall.
They took us to another room while Dr. Kazaro examined (Jimmie). At this time they told us that Jimmie had been sexually abused.
My husband and I immediately went into shock. We told Judy Howard it was impossible for Jimmie to be sexually abused!
I then told Judy Howard that Jimmie had something medically wrong and I wanted them to find out what was wrong with Jimmie! Judy Howard told us that they were going to find out what was wrong.
Then Dr. Kazaro looked at him. Then the doctor told the nurse he wanted the victim kit.
I asked what they were doing.
The doctor told my husband and I that the baby was sexually abused.
Then Dr. Kazaro roughly examined him. The doctor grabbed Jimmie by the ankles and lifted him up in the air with his head still on the bed and twisted. Then he put Jimmie back on the bed, then grabbed his ankles again and roughly turned him over, and his body was all twisted around.
I then said to Dr. Kazaro, "You're being a little rough on Jimmie!" After he was done he told the nurse he believed Jimmie had been sexually abused.
Then he asked who all had the baby since he was born. I told him my mother and father and husband and I were the only ones that had him. I told him my husband and I had him most of the time.
He then stated that one of us had sexually abused (our baby). My husband and I told him that we did not do that. Then I told the doctor that my son was not sexually abused, especially by us. I told him again our son was not sexually abused, that he had something medically wrong, and I insisted that he find out what was wrong with our son because I knew he was not abused by my husband or I.
