Laws and Government Websites

Alaska State Constitution - learn your rights! Have your rights been violated by DFYS? If so, you may be able to take on the system in court. Sue, sue, sue, in other words. Read about your rights, take notes, document everything that happens!! Your constitution states: "All political power is inherent in the people. All government originates with the people, is founded upon their will only, and is instituted solely for the good of the people as a whole." Take back your rights!!

Alaska State Laws - check under Title 47: Welfare, Social Services, and Institutions. Document every law you feel was violated in your case. Save and carefully file all supporting paperwork you may have.

Alaska Administrative Code - this website for AK regulations is something like a bad nightmare. You're framed in on all sides and can't get out. I believe the regulations you're looking for are in Permanent Regs, Title 7. If you can't find them here, ask your caseworker for a hard copy!! You need to read the child welfare service regs and the administrative hearing regs, in case you feel the need to file for a hearing on your case.

Division of Families and Youth Services - how appropriate can a name get? DIVISION of Families... yes, that is what they do.

Alaska State Legislature - if you want to help change DFYS laws, you should monitor this website and all laws pertaining to children, write to the legislators involved in making the decisions, and offer your testimony.

Anchorage Office of Public Advocacy - where you can find the CASA program, Guardian ad Litems, etc.

Alaska Children's Trust - this looks like another government agency you can't trust, but they want your children's trust. You may find some useful information here, but consider the source.

Adoptions Alaska - this is the child-stealer's goal - to terminate parental rights and adopt out children. There was one adoption for every 4576 citizens in Alaska in 1999. Do you realize what a high rate of adoption that is, and that it is only for one year? If you aren't scared yet, it is because you really don't understand what is going on. The state gets an adoption "bounty payment" for each child adopted out over "baseline". They are trying to double the number of adoptions by 2002 and that means they need new children in their fostering institutions. Protest this craziness! It is a government child-stealing industry scam, and though it is happening in every state, Alaska is deep into it.

Mental Health Childrens Service Delivery Model - basically they discuss their DFYS funding, and their plans for setting up in each community a "Family Resource and Care Planning Center. These centers are designed to improve direct access for children and families in need of comprehensive assessments, promote integrated service planning activities, provide ongoing care management, and broker services..." -- doesn't that just sound like what every family needs? Considering the high rate of foster custody and adoption in this state, it should be very useful. The "services" are the hoops they make parents and children jump through in hopes they will be reunited, such as psychological evaluations and counseling where more flimsy "evidence" can be garnered to use against families in court.

Ombudsman - Government Complaint System - this is a place to have your case reviewed if you find problems with it. Notice that many of the complaints are about DFYS.

Ombudsman Complaint - James Tern, 1999 - interesting complaint to Alaska Ombudsman. A man was about to be hired to work in a girl's group home and his application was not approved because his name turned up on the child abuser's list for having spanked his son nine years before.

1996 Report On "Improving the Court Process" - somewhat outdated report on Alaska's child detention court system, but you may still find useful information here. Remember, this was written prior to the Adoption and Safe Families Act of 1997 which changed things considerably.

Sitka School District Board Policies - DFYS Referrals - about half-way down the page there is some interesting information about how school employees make DFYS referrals, and a form that DFYS gives to the school requesting to interrogate a child, without the parent's knowledge. The page states that an employee who reports "in good faith" will not be held liable. For those reports made in retaliation for special ed requests and such, a lawsuit would be possible.

Note that reports dropped dramatically during the summer months, when the children were possibly out of school. Teachers have been named one of the main sources of CPS reports.

Battered Women and Their Children - examines the connections between domestic violence against women and child maltreatment (abuse and neglect). Battered women are at risk of losing their children to child welfare services.

Protect The Children - the web writer states: "Another scenario, a child that is not abused and a false allegation is made. The child is removed from a perfectly loving home and put into a strange home. Now, we have a child that is totally confused about the reasons behind such behavior. Another scenario, this child is molested. What a tragedy? Why? How does this happen? Why is this behavior allowed?"

Letter About Hospital Child Detention - this 1996 letter by Charles Rollins Jr. to the Fairbanks newspaper discusses an unjust detention and incarceration of an innocent child after a confrontation at an Alaskan emergency room.
